1) EVC has and will retain all title to, and property and copyright in, the EVC Vehicle Sales Report; and

2) The subscriber

 (A) shall not distribute, reproduce or copy the reports in any manner of form whatsoever, nor permit any person or entity so to do, without the prior written permission of the EVC;

 (B) may adapt, modify or incorporate information contained in other documents, however any such adaptation, modification or document incorporating information contained in the reports must display the following proprietary notice: Electric Vehicle Council of Australia Limited. Based on information provided by and with the permission of the Electric Vehicle Council of Australia.

 (C) shall not sell or otherwise supply the reports to any person or entity, whether for, or without, any monetary or other consideration, without the prior written permission of the EVC;

 (D) acknowledges that the EVC does not make any warranty as to the accuracy, completeness and reliability of the information in the “EVC Vehicle Sales Report”, or its suitability for any purpose, and the EVC does not accept any liability arising in any way from any omissions or errors in the report. Sales data is not necessarily limited to sales to a consumer and might include purchases by a distributor or dealer.
